Terms of Service

Last Updated: April 2026

1. Explicit Acceptance of Terms

By accessing the FXNode Dashboard, utilizing our Headless API, or deploying any infrastructure on our network, you explicitly agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you are strictly prohibited from using our services.

2. Description of Service

FXNode Cloud ("FXNode", "We", "Us", or "Our") provides B2B enterprise infrastructure, specifically designated as Managed MT5 Cloud Instances. We provide the hardware, operating system layer, and programmatic API to deploy and manage these instances.

We do not provide financial advice, trading signals, or brokerage services. FXNode acts solely as an infrastructure-as-a-service (IaaS) provider. You remain entirely responsible for the Expert Advisors (EAs), indicators, and trading strategies executed on your instances.

3. Account Security & API Obligations

You are solely responsible for maintaining the confidentiality of your Client Portal credentials and your Headless API Keys (x-fxnode-key).

  • IP Whitelisting: For your protection, API access is restricted by IP address. You are responsible for keeping your Authorized IP list up to date in the dashboard.
  • Unauthorized Access: FXNode cannot and will not be liable for any loss or damage arising from your failure to adequately secure your API keys or Dashboard access.

4. Billing, Cryptocurrency, and Refunds

All wholesale infrastructure purchases and enterprise wallet top-ups are processed exclusively via cryptocurrency through our payment processor, NOWPayments.

No Refunds: Due to the immutable nature of cryptographic blockchains and the immediate automated provisioning of physical hardware resources, all transactions are final and non-refundable. It is your responsibility to verify all deployment parameters and API commands before executing a transaction against your USD enterprise wallet balance.

5. Suspension and Automated Data Retention

FXNode operates an automated lifecycle management system. It is critical that you understand the data retention policies regarding suspended instances.

  • Suspension: If your enterprise wallet lacks sufficient funds for renewal, or if an instance expires, the system will automatically freeze the instance. All trading execution will immediately halt.
  • The 45-Day Purge: Upon suspension, your instance data is retained in a frozen state for exactly forty-five (45) days. If the instance is not reactivated within this window, our background systems will permanently and irreversibly wipe all data, EAs, and configurations from the physical host node. Data cannot be recovered after this automated purge.

6. Limitation of Liability

To the maximum extent permitted by applicable law, FXNode and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of capital, trading profits, or financial data.
  • Failures, slippage, or malfunctions of third-party EAs, trading terminal software, or third-party broker connections.
  • Service interruptions caused by upstream network providers, datacenter hardware failure, or force majeure events.

In no event shall our aggregate liability exceed the total amount paid by you to FXNode for the specific infrastructure service in the thirty (30) days preceding the event giving rise to the claim.

7. Acceptable Use Policy

You agree not to use our infrastructure for any unlawful or prohibited activities, including but not limited to:

  • Hosting malware, botnets, or participating in Distributed Denial of Service (DDoS) attacks.
  • Cryptocurrency mining on our CPU/RAM resources.
  • Attempting to bypass, exploit, or breach the hypervisor isolation or security protocols of the host nodes.

Violation of this policy will result in immediate, permanent account termination without refund.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the primary operating entity of FXNode Cloud is legally registered, without regard to its conflict of law provisions.
